1. Purpose and scope
This Legal Notice governs access to and use of the website segurosatlantico.es. Accessing the site confers the status of user and implies full acceptance of these terms.
2. Insurance distribution activity and registration
The Owner carries out insurance distribution activity as an exclusive insurance agent, in accordance with Spanish Royal Decree-Law 3/2020 of 4 February. He is entered in the Administrative Register of Insurance and Reinsurance Distributors of the DGSFP under number C0058X04640106V, which can be verified at https://www.dgsfp.mineco.gob.es
The Owner acts in the name and on behalf of Mapfre, the insurance undertaking with which he holds an exclusive agency agreement. Accordingly, the Owner does not provide independent advice based on a fair analysis of a range of insurers: the products offered are those of that undertaking. Full details of the insurer will be provided to the user before any contract is concluded, in accordance with article 128 et seq. of Royal Decree-Law 3/2020.
3. Intellectual property
The Owner holds all rights over the content of the site (texts, graphics, design and structure) unless otherwise stated. Its reproduction, distribution or transformation without express written authorisation is prohibited.
3 bis. Third-party trade marks
MAPFRE and the other distinctive signs of the insurance company are registered trade marks of their respective proprietors. This site is not an official website of that company and is not operated by it. It is mentioned for identification and information purposes only, in compliance with the duty of information laid down in articles 128 et seq. of Spanish Royal Legislative Decree 3/2020 and under the referential use permitted by article 37 of Spanish Act 17/2001 of 7 December on Trade Marks, without this giving rise to any connection with, sponsorship of or approval of this site by the trade mark proprietor.
4. Exclusion of warranties and liability
The content is for information purposes only and does not constitute a contractual offer or binding advice. Any indicative prices shown on the site are estimates and are not binding on the Owner or the insurer. The Owner does not guarantee the availability or continuity of the site, nor is he liable for damage arising from its use or from errors in its content.
5. Pre-contractual information
Before any insurance contract is concluded, the Owner will provide the prospective policyholder with the information required by articles 128 to 132 of Royal Decree-Law 3/2020, including:
- Name and status as an exclusive insurance agent.
- DGSFP registration number and how to verify it.
- Name and details of the insurance undertaking.
- The nature of the remuneration received.
- Available complaints procedures.
6. Complaints
In the event of disagreement, the user may contact:
- The Owner, at the address given above.
- The Customer Service Department of the associated insurance undertaking.
- The DGSFP Complaints Service, Paseo de la Castellana 44, 28046 Madrid, Spain.
7. Applicable law
This Legal Notice is governed by Spanish law. For any dispute, the parties submit to the Courts and Tribunals of Santa Cruz de Tenerife, without prejudice to the rights to which the user is entitled as a consumer.
Privacy Policy
1. What data do we collect, and how?
On the one hand, we collect the data that the user actively and voluntarily provides through:
- Web form: when the user submits the quote request form (name, phone and/or email, the line of insurance of interest and, if written, the message text).
- WhatsApp: when the user starts a conversation using the contact buttons on the site (name, telephone number, message content).
- Email: when the user writes to any of the published addresses.
- Telephone call: when the user calls any of the numbers provided.
- Visiting our office in Los Cristianos in person.
On the other hand, the site uses cookieless web analytics tools that generate aggregate usage statistics (page views, traffic source, device type, country). These tools do not set cookies, do not access device storage and do not build profiles or device fingerprints capable of identifying a specific individual. The site has a quote request form, described in section 2 bis.
2. Purposes and legal basis
- Answering the request sent through the web form — legal basis: the data subject’s consent, given by ticking the acceptance box (Art. 6.1.a GDPR), without prejudice to the relationship later becoming pre-contractual (Art. 6.1.b GDPR).
- Answering enquiries and preparing quotes — legal basis: pre-contractual measures taken at the data subject's request (art. 6(1)(b) GDPR).
- Arranging and administering policies, including claims handling — legal basis: performance of a contract (art. 6(1)(b) GDPR) and compliance with legal obligations (art. 6(1)(c) GDPR).
- Obtaining aggregate website usage statistics — legal basis: legitimate interest in understanding and improving how the site works (art. 6(1)(f) GDPR), without building individual profiles.
2 bis. The quote request form
The site’s form collects only what is needed to reply: name, one contact method (phone, email or both), the line of insurance being asked about and, optionally, free text.
- It is voluntary. You can contact us by phone, WhatsApp or in person at the office without leaving any data on the site.
- It is not sent without express consent. The acceptance box for this policy must be ticked; without it the form is not submitted.
- There are no automated decisions and no profiling. A person at the office reads and answers the message.
- It is not used for marketing unless you authorise it separately and expressly.
- Do not put sensitive data in the free text. Do not include health information, bank details or document numbers: those are handled later, through the appropriate channel.
Technically, the submission is processed on the site’s own domain, hosted on Cloudflare, and the content is forwarded to the office mailbox. The data is kept while the enquiry is handled and, if it does not lead to a contract, for a maximum of one year from the last contact.
3. Data retention
- Insurance contract documentation: 6 years from termination of the contract (art. 30 of the Spanish Commercial Code).
- Anti-money-laundering documentation: 10 years (Spanish Law 10/2010).
- Enquiries that do not lead to a contract: a maximum of 1 year from the last contact.
- Website usage statistics: in aggregate form, subject to the retention periods of the providers listed in section 4.
4. Recipients and data processors
Data is not disclosed to third parties, except in the following cases:
- Mapfre, the insurance undertaking with which the Owner holds an agency agreement, to the extent necessary to administer the policy and any claims.
- Supervisory authorities (DGSFP, SEPBLAC) where required by law.
- Overtracking, a cookieless web analytics provider, GDPR-compliant and with servers located in the European Union. It processes technical data about the visit on the Owner's behalf.
- Cloudflare, Inc., hosting, content delivery network and cookieless web analytics provider. It processes the connection's IP address as a necessary part of providing the service.
International transfers: data processed by Overtracking remains on servers located within the European Union. Cloudflare, Inc. is a United States entity; any transfers arising from the provision of its services are covered by the appropriate safeguards set out in Chapter V of the GDPR (standard contractual clauses and, where applicable, the EU–US adequacy framework). Users may consult both providers' own privacy policies for their processing terms.
5. Data subject rights
At any time you may exercise the following rights before the Controller, in writing to info@segurosatlantico.es or to the postal address given above:
- Access — to know what data is processed.
- Rectification — to correct inaccurate or incomplete data.
- Erasure — to request deletion when the data is no longer necessary.
- Restriction — to request suspension of processing (art. 18 GDPR).
- Portability — to receive the data in a structured format.
- Objection — to object to processing, including processing based on legitimate interest (art. 21 GDPR).

6. Security
Appropriate technical and organisational measures are applied to ensure a level of security appropriate to the risk, in accordance with article 32 of the GDPR. The site is served entirely over an encrypted connection (HTTPS) and applies a restrictive content security policy.
